Vacation Rental Booking

The sending of the completed Microsoft Word booking form or Adobe PDF booking form confirms your acceptance of the terms & conditions set out below & shall be binding on all persons stated on the booking form. Each booking will be confirmed by the owner, as soon as possible after receiving the booking form & deposit & only on receipt of this confirmation by you will the booking be treated as confirmed. Once the owners have confirmed the booking to you & you have paid a deposit, the named person on the booking form will be responsible for the total rental price of the property, as agreed. The remaining balance of the agreed rental cost must be paid twelve weeks prior to your departure. If the full balance of the rental cost is not paid as in accordance with these booking conditions, we reserve the right to cancel your booking. In these circumstances your reservation deposit will be forfeited.

Security Deposit

The sending of the booking form confirms your acceptance to pay for any damage of any kind caused by your occupancy of the property. The cost of repairs &/or replacements will be deducted from your security deposit. The security deposit will be refunded within 28 days after your departure from the property, providing there are no claims against it. In the event of any excess damage of any kind, excessive cleaning costs by our agents or excessive use of electricity (caused by leaving external doors open with the air conditioning on) the named person on the booking form will be held responsible for all additional costs which exceed the security deposit.

Booking Amendments

The owners will wherever possible try to accommodate changes however if within 12 weeks of departure we reserve the right to treat this as an owner cancellation. Some changes may alter the price of your vacation, i.e. duration change or adding pool heating. We will tell you of any price changes before we confirm a booking alteration.

Rental Cancellations

Providing the owners receive written notice of cancellation not less than 12 weeks prior to the actual booking date, the signatory will not be liable to pay the full balance & the deposit will be returned (after subtracting PayPal/bank fees where applicable). It is the responsibility of the signatory to ensure that the signed cancellation letter reaches the owner. Email cancellations are not acceptable. If the cancellation is received after 12 weeks prior to the start of the vacation the signatory is liable to pay the full balance of the final invoice. If the owner is successful in re letting the property for all or part of the reservation period, the full balance or the part balance of the final invoice will be refunded. The owners reserve the right to cancel any bookings providing written notice is given & any balance paid refunded. In the unlikely event that circumstances beyond our control, necessitate cancellation of the booking, we will refund any monies paid to the party leader (without interest, compensation or consequential loss of any kind).

Complaints

If you have a complaint you must tell us or our management company immediately. If we cannot resolve the problem at the time, you must notify us of your complaint within 30 days of your return. If you do not inform us about a complaint during your stay then we will not investigate the matter on your return unless there is a valid reason for not telling us.

Responsibilities

All persons stated on the booking form are responsible for the care of the property & are expected to take reasonable care of it including the locking of all doors, topping up of pool water (as required) & ensuring that the rubbish bins are left out on the appropriate collection day & brought back into the garage on the same day. At the end of the rental period, all utensils, carpets, furnishings, walls, fittings must be left clean & tidy. It is the guest’s responsibility to notify the management company immediately of any sudden equipment failure so that reasonable action can be take to rectify the situation.

Party Size

Everyone occupying the property must be listed on the booking form, including small children. This is Florida state law & must be adhered to. The accommodations cannot be shared or sub-let & only the persons shown on the booking form are permitted to stay in the property. Persons under 21 years of age are not acceptable unless accompanied by parents or responsible adults. The property is fully licensed for short-term rentals in Florida. On no account may the number of persons including children exceed the maximum occupancy of 8 people. The owners reserve the right to refuse admittance if these conditions are not met. Failure to comply will render the booking void & no compensation will be paid.

Telephone Calls

The property has telephones from which free local and long distance calling to anywhere within the USA is permitted. We also provide guest access to free international calls (landlines only). The owners reserve the right to withdraw this service without notice to prevent misuse. We also cannot be held responsible if the service fails, however, we will try our best to rectify the situation if notified. Calls to cells/mobiles & special services numbers such as caller-paid information service numbers beginning 07, 08 (i.e. 0800, 0845, etc), & 09 are chargeable. All chargeable calls made during your stay will be deducted from your security deposit. Alternatively you can purchase a phone card from many places including supermarkets & petrol stations. The property telephone number will be provided to you prior to departure.

Internet & Computer Use

High speed internet access & use of a computer are provided free of charge. Unfortunately the management company or ourselves cannot be held responsible if the service fails, however, we will try our best to rectify the situation if notified. When using the computer or accessing the internet, you or your party will not

Failure to observe this condition will be deemed unacceptable behaviour & will result in your booking being terminated immediately without compensation.

Sat Nav

Use of a Sat Nav is provided free of charge. Unfortunately the management company or ourselves cannot be held responsible if it fails, however, we will try our best to rectify the situation if notified. Please ensure it is left at the villa upon your departure. Failure to do so will result in the cost of a replacement being deducted from your security deposit.

Pool

Children must be supervised by responsible adults at all times when using the pool. Glass or crockery is not permitted within the pool area. The swimming pool is not heated unless requested, pool heating must be requested & paid for at time of booking unless by prior arrangement. It is the guests responsibility to cover the pool each night to maintain the optimum temperature. If the pool heater cannot reach optimum temperature due to adverse cold weather conditions the owners & management company cannot accept liability.

BBQ

A gas barbeque is provided free of charge by the owners at Lake Berkley 1 & Chatham Park however it may be necessary for guests to re-fill the gas canister at their own expense. Lake Berkley 2 has a George Foreman electric BBQ available free to guests. Please note that the management company are in no way responsible for the barbeque. Gas refills can be carried out by taking the empty canister to the nearest Home Depot store and they will replace it with a full one. We always recommend giving the barbeque a clean before first use. You may wish to cook on aluminium foil rather than directly on the grill. It is also the guests responsibility to ensure that the BBQ is cleaned thoroughly upon departure. We reserve the right to charge an additional cleaning fee of $40/£20 if this is not carried out satisfactorily.

Dustbin Collection

Rubbish is collected once a week. Dustbins should be left out the night before & MUST be returned to the bin enclosures at the side of the villas on the day of collection otherwise a fine will be levied against the owner & as such we will deduct this amount from the guests security deposit.

Smoking Policy

For the safety & comfort of all our guests smoking is not permitted within the property. Any costs associated with damage or extra cleaning caused by smoking inside the property will be deducted from your security deposit. By law the property is fitted with smoke alarms/detectors. It is an offence to interfere with or disconnect them. Smoking is allowed outside & within the pool area. Please dispose of cigarette butts sensibly as these are a potential fire risk.

Pets Policy

No pets are allowed. Failure to observe this condition will be deemed unacceptable behaviour & will result in your booking being terminated immediately without compensation.

Pests

Florida is sub-tropical & as such insects & other pests are common place & are not a cause of complaint or compensation. Their presence is no reflection on the cleanliness of the property. Our villa is treated regularly as part of a pest & termite control program. Please do not leave food on counter tops or in the pool area, please clean up all spillages immediately & do not eat in the bedrooms. We advise you to keep all windows & external doors closed whenever possible, not only will this help to keep pests from entering the property but it will also enable to the air conditioning system to function more efficiently.

Vacation Rental Liability

The owners & the management company of the property accept no responsibility whatsoever for death, personal injury, accidents, loss or damage to persons or personal belongings however caused. The use of all accommodations & amenities including the pool is entirely at the guest’s own risk. The owners or management company cannot accept any liability for any loss of rental time due to travel problems, flight delays or cancellations, industrial disputes or any events outside our control, including any form of Force Majeure. The owners & the management company cannot accept responsibility for the sudden failure of villa equipment but will take immediate reasonable action to rectify any such failure upon notification by the guests.

Arrivals & Departures

The villa will be available for occupancy from 4pm on the date of arrival & must be vacated by 11am (prompt) on the day of departure. Your cooperation in this matter would be greatly appreciated in order that our villa can be prepared for incoming guests. If arranged in advance we may be able to allow a later check-out. An additional fee may apply. We reserve the right to deduct a days rental from a guests security deposit for any unauthorised early check-in or late check-out.

Travel Insurance

It is a condition of the booking that all members of the Party are covered by travel insurance which carries adequate protection against delays & cancellations, & has adequate medical insurance for the USA, & for your luggage & personal belongings.

Force Majeure

As with any other vacation, there maybe circumstances completely beyond our control & contemplation, in which the property might not be available for your booking. Examples of these circumstances include (but are not limited to) destruction of or severe damage to the property. Such circumstances are referred to Force Majeure. In the event of Force Majeure the owners will do their best to make alternative arrangements for you where possible. If they cannot, or if the alternative arrangements are not acceptable to you, then they will refund all monies paid. This will be the full extent of the owner’s liability to you in such circumstances, & they shall not be responsible for any other costs connected with any such cancellation, howsoever arising.

Owner Access

The owners or their management company shall be allowed access at any reasonable time during your stay.

Law

This conduct is subject to & shall be construed in accordance with the laws of Osceola & all parties hereby submit to the exclusive jurisdiction of the Osceola Courts.

Code of Conduct

Lake Berkley Resort & Chatham Park Resort are residential communities. The actions of all members of your party should not interfere with the enjoyment of either other vacationers or residents. Please do not play loud music or engage in any activity which may cause inconvenience to your neighbours after 9pm or before 9am. No street parking is permitted. In the event that any member of your party behaves in a way that is likely to cause distress, danger or annoyance to any other vacationers, residents or damage to any property, the owners or there management company reserve the right to terminate your rental agreement immediately & forthwith. The owners or their management company will not be liable for any costs you will incur, nor shall we pay any compensation, nor make any refunds due to this action.

Website Accuracy

Whilst every effort is made to ensure the accuracy of the website & prices at the time of booking, regrettably errors do occasionally occur. We & our management company inspect our property & resort facilities regularly to ensure the contents of this website are accurate, however, circumstances can change after publication & we reserve the right to make these changes. All such information is provided in good faith & we are excluded from liability for any errors, omissions or misleading information (unless made recklessly or fraudulently).

"Refer A Friend" Free Accommodation Offer

This offer is subject to the following conditions:- A referral must result in a minimum stay of 7 nights in our villa. When booking the guest must advise that they were referred giving full details on who referred them. The referrer must have stayed at one of our villas. This offer does not include pool heating & if required must be paid separately. If the stay is for less than 5 nights then a cleaning surcharge is applicable. Free nights are subject to availability. This offer cannot be used in conjunction with any other offer or discount. This offer is at the owner's discretion & can be removed at any time without prior notice

Changes to Terms & Conditions

We may at any time change or modify all or any part of these Terms & Conditions. Current Terms & Conditions are always available on our website & it's your responsibility to check whether any amendments have been made.
